Asked whether he would now &#8216;check out the human rights record in Baku&#8217;, <a title=\"Ecclestone gives Azerbaijan the all-clear\" href=\"http:\/\/uk.reuters.com\/article\/2015\/04\/19\/uk-motor-racing-prix-ecclestone-idUKKBN0NA0IK20150419?irpc=932\" target=\"_blank\">Ecclestone responded: &#8216;We have. I think everybody seems to be happy. Doesn&#8217;t seem to be any big problem there.<\/a>&#8216;&#8221;<\/p>\n<p style=\"text-align: justify;\">Before anyone rushes to judgement and begrudges Baku its first Formula One race next year \u2013 or its upcoming <a title=\"Azerbaijan: Release Activists, Journalists Behind Bars\" href=\"http:\/\/www.hrw.org\/news\/2015\/04\/20\/azerbaijan-release-activists-journalists-behind-bars\" target=\"_blank\">European Olympics<\/a> \u2013 let us admit that Bernie Ecclestone has a point.<\/p>\n<p style=\"text-align: justify;\">There is no reason to expect sports organisations to condemn a regime for human rights abuses that is praised by the leading clubs of European democracies: the Council of Europe and the European Union. The time when Formula One cares more about human rights than these bodies has not yet arrived, though it might soon, the way things are going.<\/p>\n<p style=\"text-align: justify;\">If the European External Action Service (EEAS) had been around in 1980, this is the statement it might have issued:<\/p>\n<p style=\"text-align: justify;\">&#8220;The four year sentence imposed by a Czechoslovak court on Mr Vaclav Havel, a well-known human rights defender and respected writer, appears harsh and disproportionate to the alleged offences on which it is based. Procedural shortcomings raise concerns about due legal processes.<\/p>\n<p style=\"text-align: justify;\">The EU calls on the Communist Party of Czechoslovakia to establish greater trust in the independence and professionalism of its judicial system. We look to the authorities in the Czechoslovak Socialist Republic to ensure that Vaclav Havel is given the opportunity to appeal this verdict in a fair and unbiased process.&#8221;<\/p>\n<p style=\"text-align: justify;\">How do we know this? Because this <a title=\"Statement by the Spokesperson on the sentencing of Rasul Jafarov, a prominent Human Rights Defender in Azerbaijan\" href=\"http:\/\/eeas.europa.eu\/statements-eeas\/2015\/150416_05_en.htm\" target=\"_blank\">is exactly how the EEAS responded last week<\/a> to the prison sentence of 6.5 years against leading <a title=\"ESIWEB Rasul Jafarov\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=577\" target=\"_blank\">human rights defender Rasul Jafarov<\/a> in Azerbaijan.<\/p>\n<p style=\"text-align: justify;\">The charges and his trial were a farce. All the witnesses of the prosecution were either not aware why they were supposedly victims or testified in Rasul&#8217;s favour. The court did not consider their statements. One of the witnesses had to flee the country afterwards to avoid reprisals for his honest testimony.<\/p>\n<p style=\"text-align: justify;\">Vaclav Havel might have said to himself in his prison cell about the EEAS statement: &#8220;I know this language. This is the content-free jargon of the functionaries in the Garden Party.&#8221;<\/p>\n<p style=\"text-align: justify;\">In the play &#8220;The Garden Party&#8221;, which Havel wrote in 1963 in communist Czechoslovakia, the main character, Hugo Pludek, becomes so good at speaking in platitudes and clich\u00e9s that he ends up as head of the Central Inauguration and Liquidation Committee. By the end of the play, this master of mindless speechifying loses his identity.<\/p>\n<p style=\"text-align: justify;\">Tadeusz Iwinski, member of the Polish Parliament, Deputy Chairperson of the Socialist Group in the Parliamentary Assembly of the Council of Europe (PACE) and monitor for Azerbaijan, is a modern Hugo Pludek.<\/p>\n<p style=\"text-align: justify;\">Iwinski was born in 1944. As a young man he joined the Polish United Workers&#8217; Party (the communist party in Poland). Since 1992 he has been a member of the Parliamentary Assembly of the Council of Europe (PACE). Iwinski has a Pludekesque gift for phrases and concepts, often displayed in his long history of defending the regime in Baku.<\/p>\n<p style=\"text-align: justify;\">June 2010 \u2013 PACE<\/p>\n<p style=\"text-align: justify;\">During a debate in PACE Tadeusz Iwinski explains that &#8220;in recent years, Azerbaijan has opted for European standards in respect of human rights, democracy and the rule of law.&#8221;<\/p>\n<p style=\"text-align: justify;\">November 2010 \u2013 Baku<\/p>\n<p style=\"text-align: justify;\">In Baku in 2010 Iwinski, then deputy head of the PACE election monitoring mission, tells Audrey Glover, head of the mission of the OSCE&#8217;s Office of Democratic Institutions and Human Rights (ODIHR), that her critical position on the elections is &#8220;idiotic&#8221;. ODIHR had concluded that: &#8220;regrettably \u2026 the conditions necessary for a meaningful democratic election were not established&#8221;. For more on this see: <a title=\"Caviar Diplomacy. How Azerbaijan silenced the Council of Europe\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=156&amp;document_ID=131\" target=\"_blank\">Caviar Diplomacy<\/a>.<\/p>\n<p style=\"text-align: justify;\">January 2011 \u2013 PACE<\/p>\n<p style=\"text-align: justify;\">In PACE Iwinski reports on the parliamentary elections in Azerbaijan. He notes that the &#8220;whole election process showed progress in reaching Assembly and OSCE standards and commitments.&#8221;<\/p>\n<p style=\"text-align: justify;\">Instead of the government he blames the opposition, which won not a single seat: &#8220;the opposition has a share of its responsibility in the absence of a vibrant public debate in Azerbaijan; the opposition should focus on real issues rather than on egocentric petty politicking.&#8221; He complains about &#8220;serious frictions and nearly insurmountable difficulties in [the PACE delegation&#8217;s] interplay with the ODIHR.&#8221;<\/p>\n<p style=\"text-align: justify;\">April 2011 \u2013 PACE<\/p>\n<p style=\"text-align: justify;\">Iwinski is one of 35 PACE members who demand that PACE adopt <a title=\"Criteria for the definition of a political prisoner\" href=\"http:\/\/assembly.coe.int\/ASP\/Doc\/XrefViewHTML.asp?FileID=12668&amp;Language=EN\" target=\"_blank\">&#8220;objective criteria&#8221; on how to identify &#8220;a genuine political prisoner&#8221;<\/a> before any report on any individual country is prepared. As a result, a report on political prisoners in Azerbaijan is <a title=\"Ilham the Magician and the Council of Europe\" href=\"https:\/\/www.facebook.com\/media\/set\/?set=a.10151229726987122.479493.94999142121&amp;type=1\" target=\"_blank\">delayed<\/a>.<\/p>\n<p style=\"text-align: justify;\">3 October 2012 \u2013 PACE<\/p>\n<p style=\"text-align: justify;\">During <a title=\"Showdown in Strasbourg. The political prisoner debate in October 2012\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=156&amp;document_ID=135\" target=\"_blank\">a debate on the definition of political prisoners<\/a>, Iwinski votes for an amendment that states that PACE should not speak out on human rights and should not adopt a definition of political prisoner after all: &#8220;The interpretation and application of any criteria defining a political prisoner are the exclusive competence of the European Court of Human Rights, which is the only authority to assess violations of fundamental rights and freedoms, as stipulated in the European Convention for Human Rights and its Protocols.&#8221;<\/p>\n<p style=\"text-align: justify;\"><a title=\"PACE (Fourth part)  REPORT  Thirty-third Sitting\" href=\"http:\/\/assembly.coe.int\/Main.asp?link=\/Documents\/Records\/2012\/E\/1210031530E.htm\" target=\"_blank\">Iwinski explains<\/a>: &#8220;I am speaking as a scholar rather than as a politician. It is difficult to get everyone&#8217;s agreement on any definition in the social sciences \u2026 The definition of &#8216;political prisoner&#8217; seems, to some extent at least, to belong to a political category \u2013 it is delicate or even &#8216;tricky&#8217;, as the Americans would say.&#8221;<\/p>\n<p style=\"text-align: justify;\">23 January 2013 \u2013 PACE<\/p>\n<p style=\"text-align: justify;\">Iwinski <a title=\"Azerbaijan debacle: The PACE debate on 23 January 2013\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=156&amp;document_ID=136\" target=\"_blank\">votes against the resolution on political prisoners<\/a> in Azerbaijan submitted by the PACE rapporteur Christoph Str\u00e4sser, today the German government&#8217;s Commissioner for Human Rights. <a title=\"PACE (First part)  REPORT  Sixth sitting\" href=\"http:\/\/assembly.coe.int\/Main.asp?link=\/Documents\/Records\/2013\/E\/1301231530E.htm\" target=\"_blank\">Iwinski declares<\/a>: &#8220;I am convinced that Azerbaijan will continue to meet its commitments and obligations. I hope that the presidential elections in the autumn will be credible and will contribute to further co-operation with our Organisation.&#8221; The 2013 elections in Azerbaijan turn into another farce, but PACE election observers <a title=\"Disgraced. Azerbaijan and the end of election monitoring as we know it\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=156&amp;document_ID=145\" target=\"_blank\">praise it again as &#8220;free and fair.&#8221;<\/a><\/p>\n<p style=\"text-align: justify;\">16 April 2015 \u2013 Baku<\/p>\n<p style=\"text-align: justify;\">Rasul Jafarov is sentenced to six and a half years in prison.<\/p>\n<p style=\"text-align: justify;\">17 April 2015<\/p>\n<p style=\"text-align: justify;\">The PACE co-rapporteurs for the monitoring of Azerbaijan Iwinski and <a title=\"A Portrait of Deception. Monitoring Azerbaijan or why Pedro Agramunt should resign \" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=156&amp;document_ID=134\" target=\"_blank\">Pedro Agramunt<\/a> (Spain) <a title=\"Azerbaijan: monitoring co-rapporteurs say Jafarov sentence \u2018could be perceived as disproportionate\u2019, call for fair appeal\" href=\"http:\/\/assembly.coe.int\/nw\/xml\/News\/News-View-EN.asp?newsid=5525&amp;lang=2&amp;cat=3\" target=\"_blank\">declare the following<\/a> in a press statement:<\/p>\n<p style=\"text-align: justify;\">&#8220;&#8216;We met Rasul Jafarov during our monitoring visit to Azerbaijan in March when he was in pre-trial detention and he told us that the charges against him were politically motivated. Such a long sentence against a human rights defender for charges in connection to administering an NGO could be perceived as disproportionate.'&#8221; The co-rapporteurs said they were confident the authorities will take the necessary steps to ensure fairness, equality of arms and respect for the presumption of innocence, in compliance with Article 6 of the European Convention on Human Rights, will be respected during his appeal procedure.&#8221; (emphasis added)<\/p>\n<p style=\"text-align: justify;\">22 April 2015\u2013 Baku<\/p>\n<p style=\"text-align: justify;\"><a title=\"ESIWEB Intiqam Aliyev\" href=\"http:\/\/www.esiweb.org\/index.php?lang=en&amp;id=578\" target=\"_blank\">Human rights laywer Intiqam Aliyev<\/a> is sentenced to seven and a half years in jail.<\/p>\n<p style=\"text-align: justify;\"><strong>And now? What everyone can do<\/strong><\/p>\n<p style=\"text-align: justify;\">Watching this modern re-enactment of the Garden Party in Strasburg, you have a few options how to react.<\/p>\n<p style=\"text-align: justify;\">You can cry. You can laugh. You can buy your ticket and join Azerbaijan&#8217;s many European friends in the luxury hotels in Baku for the upcoming European Olympics.<\/p>\n<p style=\"text-align: justify;\">Or you can take 15 minutes and do any of the following:<\/p>\n<p style=\"text-align: justify;\">Write to Martin Schulz (martin.schulz@europarl.europa.eu), president of the European Parliament (EP). Ask him to insist that Azerbaijan allows a delegation from the parliament to visit political prisoners, including Leyla Yunus, <a title=\"Denis Mukwege: winner of Sakharov Prize 2014\" href=\"http:\/\/www.europarl.europa.eu\/news\/en\/news-room\/content\/20141016STO74202\/html\/Denis-Mukwege-winner-of-Sakharov-Prize-2014\" target=\"_blank\">as the presidency of the EP had announced in October 2014<\/a> when it decided on the parliament&#8217;s 2014 Sakharov Award and Leyla was one of the three finalists. So far, Azerbaijan simply refuses to let them visit and gets away with it without even a public protest.<br \/>\nWrite to Elmar Brok (elmar.brok@europarl.europa.eu), chair of the EP&#8217;s foreign affairs committee. Demand that the EU takes its <a title=\"European Parliament resolution of 18 September 2014 on the persecution of human rights defenders in Azerbaijan \" href=\"http:\/\/www.europarl.europa.eu\/sides\/getDoc.do?type=TA&amp;reference=P8-TA-2014-0022&amp;language=EN&amp;ring=P8-RC-2014-0090\" target=\"_blank\">September 2014 Azerbaijan resolution<\/a> seriously where it stressed that its consent to the signature of an agreement with Azerbaijan &#8220;will be conditional on the satisfactory reflection of the above-mentioned requirements [on human rights], the release of human rights defenders&#8230;&#8221; The EP <a title=\"EU\/Azerbaijan Framework Agreement: general principles for the participation of Azerbaijan in Union programmes. Protocol to the EC\/Azerbaijan Partnership and Cooperation Agreement\" href=\"http:\/\/parltrack.euwiki.org\/dossier\/2013\/0420%28NLE%29\" target=\"_blank\">is in the process<\/a> of approving <a title=\"Proposal for a COUNCIL DECISION on the conclusion of a Protocol to the Partnership and Cooperation Agreement between the European Communities and their Member States and the Republic of Azerbaijan\" href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:52013PC0865\" target=\"_blank\">a framework agreement that will allow Azerbaijan to participate in Union programmes<\/a>. It will be able to cooperate with the EU in fields such as education, youth and research \u2013 without any release of political prisoners in return.<br \/>\nWrite to PACE President Anne Brasseur (anne.brasseur@coe.int) and head of the Monitoring Committee Stefan Schennach (stefan.schennach@parlament.gv.at) and ask them to push for Tadeusz Iwinski to return his mandate as rapporteur for Azerbaijan. Due to his consistent pro-regime bias Iwinski has violated the &#8220;principle of neutrality, impartiality and objectivity&#8221; enshrined in the <a title=\"Code of conduct for rapporteurs of the Parliamentary Assembly\" href=\"http:\/\/assembly.coe.int\/nw\/xml\/RoP\/RoP-XML2HTML-EN.asp?id=CHDBFHJD#Format-It\" target=\"_blank\">Code of Conduct for Rapporteurs<\/a>. Also ask them to ensure that an unbiased rapporteur replaces Pedro Agramunt when his mandate expires in June.<br \/>\nInform the Polish media about the antics of Polish MP Iwinski. He is betraying the proud legacy of Polish democratic dissent to communism.<\/p>\n<p style=\"text-align: justify;\">Vote for Rasul Jafarov for the <a title=\"Finalists for the 2015 Front Line Defenders Award for Human Rights Defenders at Risk\" href=\"https:\/\/www.frontlinedefenders.org\/node\/28174\" target=\"_blank\">2015 Frontline Defenders Award<\/a>.<\/p>\n<p style=\"text-align: justify;\">To set free any political prisoners will require much greater efforts. But taking these small steps will at least send a signal that not everyone in Europe&#8217;s democracies is ready to follow in the path of Hugo Pludek. As Rasul Jafarov <a title=\"Open Letter of Jailed Human Rights Activist Rasul Jafarov to International Community \" href=\"http:\/\/azerireport.com\/index.php?option=com_content&amp;task=view&amp;id=4389&amp;Itemid=42\" target=\"_blank\">wrote in 2014 in his first letter from prison<\/a>:<\/p>\n<p style=\"text-align: justify;\">&#8220;During the session of the Parliamentary Assembly of the Council of Europe held in June 2014, i.e. shortly before my arrest, a roundtable was held on the gravity of the human rights situation in Azerbaijan \u2026 in the past 2-3 years everyone was asking half-joking, half-serious, when I was going to be arrested. It happened, and now I&#8217;m looking forward to your support!
