{"id":1933,"date":"2016-03-01T14:52:59","date_gmt":"2016-03-01T14:52:59","guid":{"rendered":"https:\/\/covcasbulletin.info\/?p=1933"},"modified":"2016-03-02T09:41:17","modified_gmt":"2016-03-02T09:41:17","slug":"turkeys-optional-constitution","status":"publish","type":"post","link":"https:\/\/covcasbulletin.info\/?p=1933","title":{"rendered":"Turkey\u2019s \u2018optional\u2019 constitution"},"content":{"rendered":"<p style=\"text-align: justify;\">By MICHAEL RUBIN*<br \/>\n<em>American Enterprise Institute<\/em><\/p>\n<p style=\"text-align: justify;\">There are few countries that have plummeted in press freedom ratings <a href=\"https:\/\/www.commentarymagazine.com\/foreign-policy\/middle-east\/turkey-into-the-press-freedom-abyss\/\" target=\"_blank\">so far<\/a> <a href=\"https:\/\/www.commentarymagazine.com\/culture-civilization\/turkey-below-russia-in-press-freedom\/\" target=\"_blank\">or so<\/a> <a href=\"https:\/\/www.commentarymagazine.com\/foreign-policy\/middle-east\/time-to-speak-out-on-turkey-media-bans\/\" target=\"_blank\">fast as<\/a> <a href=\"https:\/\/www.commentarymagazine.com\/foreign-policy\/middle-east\/could-turkey-fall-below-iran-in-press-freedom\/\" target=\"_blank\">Turkey<\/a>. REUTERS\/Murad Sezer.<\/figcaption><\/figure>\n<p style=\"text-align: justify;\">When the lower court proceeded to release the two journalists, Turkey\u2019s bombastic President Recep Tayyip Erdo\u011fan said they <a href=\"http:\/\/aa.com.tr\/tr\/turkiye\/cumhurbaskani-erdogan-aymnin-kararina-saygi-duymuyorum\/528587\" target=\"_blank\">should have resisted<\/a> the decision of the constitutional court and kept the journalists in prison. Thus, he openly defied Article 153 of the <a href=\"http:\/\/global.tbmm.gov.tr\/docs\/constitution_en.pdf\" target=\"_blank\">constitution<\/a> which declares that the decisions of the constitutional court should be binding on everyone and every government arm.<\/p>\n<p style=\"text-align: justify;\">This is not the first time that Erdo\u011fan has urged disregard for the constitution and law. When he talked to kaymakams (provincial district governors) in Turkey a few weeks ago, he told them that they can disregard the legal system if circumstances dictate.<\/p>\n<p style=\"text-align: justify;\">Of course, there have long been warning signs about Erdo\u011fan\u2019s disdain for the constitution and law. Prior to his premiership and presidency, he <a href=\"http:\/\/www.nationalreview.com\/article\/215591\/will-they-or-wont-they-michael-rubin\" target=\"_blank\">famously quipped<\/a> that \u201cDemocracy is like a street car: you ride it until you arrive at your destination, then you step off.\u201d<\/p>\n<p style=\"text-align: justify;\">Then there was the statement by his parliamentary speaker (subsequently promoted to deputy prime minister) B\u00fclent Ar\u0131n\u00e7 who, a decade ago, <a href=\"https:\/\/web.archive.org\/web\/20051101214329\/http:\/www.byegm.gov.tr\/YAYINLARIMIZ\/CHR\/ING2005\/05\/05x05x03.HTM\" target=\"_blank\">suggested<\/a> in response to a constitutional court veto that the party use its supermajority to abolish the court.<\/p>\n<p style=\"text-align: justify;\">The Turkish military once was the guarantor of the Turkish constitution. Whether or not that was a wise responsibility for the military, the simple fact is that it failed at its job. So too did numerous diplomats who refused to see the writing on the wall with regard to Erdo\u011fan\u2019s true intentions.<\/p>\n<p style=\"text-align: justify;\">There are no shortage of good constitutions in the world. The problem is that so many governments willfully ignore them. By joining them, Erdo\u011fan has put Turkey firmly in the company of states like Syria, Russia, and Iran rather than the European community to which Turkish officials still pay lip service. Diplomacy is no substitute for reality.<\/p>\n<p style=\"text-align: justify;\">If Turkey\u2019s leader believes law is optional and does not apply to him, then it is long past time to acknowledge Turkey for the banana republic is has become, recognize that it is a <a href=\"https:\/\/www.aei.org\/publication\/turkey-undercuts-nato-pivots-toward-china\" target=\"_blank\">liability rather than asset<\/a> to NATO, and support European leaders who might want to slam the door shut on Turkey\u2019s European aspirations.<\/p>\n<p style=\"text-align: justify;\"><em>*Michael Rubin is a former Pentagon official whose major research areas are the Middle East, Turkey, Iran and diplomacy.
